Where should a housing society start redevelopment?

Start with property/title records, member data, the applicable planning authority and an independent feasibility process. Before comparing developer promises, understand what the plot can actually support and what the Society needs.

Is a PMC compulsory before talking to developers?

There is no single universal answer for every project. As a governance practice, an independent PMC / architect / competent consultant can help establish feasibility, tender scope and comparable evaluation before developer selection. Follow the current cooperative-housing procedure and your Society approvals.

What is feasibility in redevelopment?

Feasibility is the technical and commercial study of title, plot area, road/access, applicable FSI/TDR, existing member obligations, buildability, permissions, costs, sale potential, timelines and key risks. It should explain assumptions, not just show a headline FSI.

Why does conveyance matter?

Conveyance transfers title of the land/building to the Society. Maharashtra’s Co-operation Department identifies non-availability of conveyance as a major redevelopment hurdle and provides a deemed-conveyance route where applicable.

Is a Registrar NOC required for redevelopment?

Do not build the process around a Registrar “NOC”. The Maharashtra Co-operation Department issued a 4 November 2025 circular directing Registrars not to issue “No objection” for cooperative-housing-society redevelopment. Use the applicable Society and statutory procedure instead.

What is self-redevelopment?

In self-redevelopment the Society acts as the project owner/promoter instead of granting the entire redevelopment to an outside developer. It requires stronger title, finance, professional-team, procurement, approval, compliance and construction controls.

What is FSI?

FSI / FAR is a planning ratio used to relate permissible floor area to the relevant plot area. The exact calculation depends on the applicable rulebook, authority, road, plot conditions, scheme and deductions.

Is maximum permissible FSI always fully buildable?

No. Theoretical entitlement and actually consumable FSI can differ because of setbacks, access, fire requirements, height restrictions, plot shape, parking, reservations, aviation/CRZ or other authority conditions.

Which rule applies in Mumbai?

Greater Mumbai development is primarily governed through MCGM’s DCPR 2034 framework, subject to current amendments, scheme-specific rules and property conditions.

Which authority applies in Navi Mumbai?

Do not assume one authority for all Navi Mumbai properties. Depending on the plot, the route may involve NMMC, CIDCO, Panvel / NAINA or another planning authority. Identify the authority before relying on an FSI calculation.

Why use the same tender format for all bidders?

A common scope, deadline and evidence format makes bids easier to compare and reduces the risk that different bidders are evaluated on different assumptions.

Why use separate technical and commercial envelopes for a PMC bid?

A two-envelope process can help evaluate capability before price influences technical scoring. It is a governance method, not a universal statutory rule for every procurement. Use the procedure declared in the tender.

Can sealed bids be opened privately?

For a transparent Society process, bid receipt, custody and opening should follow the declared procedure, with records, attendance and minutes. Avoid unilateral/private opening because it creates avoidable disputes about integrity and equal treatment.

Should the cheapest PMC automatically win?

Not necessarily. A Society can use a quality-and-cost framework where experience, methodology, team, references and commercial reasonableness are compared under pre-declared criteria. The tender should state the framework before evaluation.

What should be checked before appointing a PMC?

Comparable redevelopment experience, team qualifications, local authority knowledge, methodology, references, conflicts of interest, scope exclusions, fee structure and who will actually work on the project.

What is conflict-of-interest disclosure?

It is a written disclosure of material professional, financial, referral, family or business relationships that could affect independent evaluation or advice. It helps the Society decide whether recusal or additional safeguards are needed.

Is there one licence that makes someone a real-estate developer?

There is no single universal “developer licence” that replaces project-level title, permissions, professional appointments, finance, tax, MahaRERA and construction compliance. The obligations depend on the entity, project and location.

What should a developer check before signing a land or JV deal?

Title, access, planning authority, zoning/reservation, FSI/buildability, encumbrances, landowner rights, possession, costs, premiums/TDR, finance, marketability, tax and the exact rights being granted under the agreement.

What is a Commencement Certificate (CC)?

A CC is an authority permission allowing construction to commence to the extent and stages sanctioned. The exact format and stage conditions depend on the planning authority and approved proposal.

What is an Occupancy Certificate (OC)?

An OC is issued after completion/inspection when the authority is satisfied with applicable requirements for occupation. It is a major project-closure and possession checkpoint.

Who grants building permissions in Navi Mumbai?

NMMC’s Town Planning Department handles building/development proposal approvals and occupancy certificates within its jurisdiction, while CIDCO separately provides building-permission systems and checklists for applicable areas. Always identify the plot authority first.

A DA records the development rights, responsibilities, consideration/benefits, timelines, protections, default consequences and other project terms between the relevant parties. The exact instrument must be drafted and vetted for the project.

Should a Society give a broad Power of Attorney to the developer?

Any POA should be limited to the project purpose and reviewed carefully. Avoid treating a broad, uncontrolled authority as a routine formality; define permitted acts, duration, safeguards and revocation/termination consequences with legal advice.

Is there one fixed stamp-duty percentage for every redevelopment agreement?

No. Stamp duty and registration treatment depend on the instrument, consideration, rights transferred, location and current Maharashtra rules. Identify the document first and verify the current treatment with the Registration & Stamps authority / legal professional.

Is additional carpet area legally the same in every redevelopment?

No. Member entitlement can depend on the applicable scheme, existing lawful/eligible area, planning regulations, Society tender terms and negotiated commercial offer. Verify the basis instead of comparing only a percentage headline.
